The Regulatory Reality

The EU AI Act is in enforcement. Fines for non-compliance reach up to 7% of global annual revenue. For a $1B company, that’s $70M. For a $10B company, that’s $700M.

NIST is developing AI agent security standards through the CAISI initiative. We’ve submitted formal comments to that process. SOC 2 auditors are beginning to ask about AI governance controls.

What Compliance Actually Requires

The EU AI Act’s high-risk requirements include:

The Difference Between Logging and Evidence

Every agent action generates a proof entry in an immutable chain:

  • SHA-256 hash (industry standard)
  • SHA3-256 hash (quantum-resistant backup)
  • Previous entry reference (chain integrity)
  • Agent trust score at time of action
  • Risk classification
  • Governance decision (ALLOW / DENY / ESCALATE)

Modify any entry and the chain breaks. Both hashes must verify independently. Merkle tree aggregation enables efficient batch verification at scale.

When — not if — an AI incident goes to court, the organization with cryptographic proof of their governance decisions will be in a fundamentally different legal position than the one with “logs.”
